The Austrian Federal Ministry of education, Arts and Culture (hereafter:
BMUKK) points out to the users of the online content at www.kulturleben.at (the "website") that they make use of this
content at their own risk. The BMUKK makes its best efforts to ensure the accuracy of the content described. The BMUKK
disclaims any and all warranties for the topicality, correctness, completeness or quality of the information provided.
In no event shall the BMUKK be liable for any material or immaterial damage arising from the use or non-use of the
information offered and/or the use of incorrect and incomplete information, unless the BMUKK can be proven to have
acted with malicious intent or gross negligence. All information offered is free, without any cost or obligation. The
BMUKK explicitly reserves the right to change, complement or delete parts of pages or the entire website or suspend
publication temporarily or definitively without any specific prior notification.
2. Links
The BMUKK disclaims any and all warranties for third-party content to which direct or
indirect reference is made (“links”). The BMUKK has no influence on the current and future design, content and
authorship of the linked web pages. Hence, the BMUKK hereby explicitly disclaims any responsibility for the content of
all linked pages. This disclaimer applies to all links and references within the BMUKK website as well as to entries by
third parties in any guestbook, discussion forum and mailing list the BMUKK may set up. Liability for any illegal,
inaccurate or incomplete content and especially for damage arising from the use or non-use of such content shall lie
solely with the owner of the linked page, and not with the party which merely refers to this content through a link.
3. Copyright and trademarks
The BMUKK makes every effort to observe in all publications the
copyrights of the texts, images, graphics, video sequences and sound documents used, to use texts, images, graphics,
video sequences and sound documents created by the BMUKK itself or by its contractual partners or to utilize texts,
images, graphics, video sequences and sound documents that are in the public domain. All marks and trademarks mentioned
in the Internet content and which may be protected by third parties are subject without any restriction to the
provisions of the applicable trademark right and ownership rights of the respective registered owner. Mere mention
shall not be construed to mean that trademarks are not protected by the rights of third parties!
The copyright for published objects created by the BMUKK or its contractual partners shall remain solely with
the BMUKK (author of the pages). Any duplication or use of such graphics, sound documents, video sequences and texts in
any other electronic or printed publications shall not be permitted without the explicit approval of the author
(BMUKK).
4. Data protection
To the extent that the Internet content provides the possibility of entering
personal or commercial data (email address, name, address), the user shall disclose such data on a strictly voluntary
basis.
By entering their postal address or email address users agree (until further notice) to receive the ordered
information material (newsletter, mailings) from the BMUKK by mail and/or email. Users also agree to the computerised
storage and further processing of their data. The BMUKK shall use this personal information solely for the provision of
services ordered by users and/or to bring to the users’ attention new events, programmes, online services and services
of the BMUKK.
The data disclosed by the user shall be treated with strict confidentiality in compliance with the provisions
of the data protection law in its currently applicable version, unless there is a statutory or legal necessity to
defend rights or property of the BMUKK or to protect the interests of the other users.
5. Legal effectiveness of this disclaimer of warranty
This disclaimer of warranty shall be
considered an integral part of the Internet content which contains a reference to this page. In the event that portions
or individual phrases of this text are not or no longer in compliance or not in full compliance with the applicable
law, this does not affect the validity of the remaining parts of the document in respect of their content and validity.
